Terms of Use + Member Agreement

1. Agreement to Terms

By accessing or using any Maison Élevée website, member portal, content, products, services, programs, communications, or the Sovereign Club membership (collectively, the "Services"), you agree to be bound by these Terms of Use and Member Agreement ("Terms"). If you do not agree, do not use the Services.

You represent that you are at least 18 years old and have the legal capacity to enter into a binding contract.

2. Scope of Services

Maison Élevée provides a luxury lifestyle, style, self-elevation, and mindset platform which may include, without limitation: digital content, educational materials, live or recorded calls, community experiences, coaching or consulting-style content, templates, checklists, events, and physical goods such as clothing, accessories, and made-to-measure ("MTM") garments.

Educational Only / No Professional Advice. The Services are for educational and informational purposes only. Nothing within the Services constitutes or should be construed as medical, psychological, therapeutic, clinical, legal, financial, tax, or investment advice. You are solely responsible for your decisions, actions, and results.

3. Membership; Subscription; Billing; No Refunds

3.1 Sovereign Club Membership

Sovereign Club is offered as a recurring monthly membership and may include an annual discounted option. Membership features may change over time.

3.2 Billing & Auto-Renewal

By purchasing a subscription, you authorize us (and our payment processor, including Stripe) to charge your payment method on a recurring basis until you cancel. Monthly subscriptions renew monthly; annual subscriptions renew annually unless otherwise disclosed at checkout.

3.3 Cancellation

You may cancel anytime through your account settings or by contacting support at: maisoneleveeofficial@gmail.com. Cancellation stops future renewals; you will retain access through the end of the then-current billing period unless otherwise stated.

3.4 No Refunds

ALL SALES ARE FINAL. NO REFUNDS, NO CHARGEBACKS, AND NO PRORATIONS will be provided for any reason, including without limitation non-use, dissatisfaction, mistaken purchases, forgotten cancellations, changes in personal circumstances, or feature changes, except where required by applicable law.

4. Ateliers, Partners, Affiliates; Assumption of Risk; No Responsibility

Maison Élevée may introduce you to, recommend, refer you to, or facilitate access to third-party ateliers, makers, partners, or service providers (including, by way of example, ateliers associated with Andrea Lombardi and Ryan Eggebrecht) (collectively, "Ateliers/Partners"). In such cases:

  1. Third-Party Relationship. Any goods or services provided by Ateliers/Partners are offered by independent third parties, not by Maison Élevée.
  2. Affiliate/Referral Model. Maison Élevée may receive affiliate fees, referral fees, commissions, or other compensation in connection with referrals.
  3. No Responsibility. Maison Élevée is not responsible or liable for any Atelier/Partner goods, services, performance, communications, representations, warranties, delays, defects, fit, quality, pricing, fulfillment, alterations, returns, refunds, disputes, injuries, losses, or damages.
  4. Client Assumes All Risk. You assume all risks associated with engaging any Atelier/Partner, including any disputes, losses, or claims.
  5. Direct Contracting. Any purchase or engagement with an Atelier/Partner is solely between you and that third party, subject to their terms and policies.

5. Account Registration; Security; Unauthorized Use

To access portions of the Services, you may need an account. You agree to provide accurate information and keep it current. You are responsible for maintaining confidentiality of credentials and for all activity under your account.

You must notify us immediately of suspected unauthorized access. We may suspend or terminate accounts we believe are compromised.

6. Strict Prohibited Conduct (Zero-Tolerance)

You agree you will not, and will not attempt to:

The Services may include confidential methods, processes, playbooks, resources, and/or business information ("Confidential Information"). You agree:

8. Intellectual Property; Limited License

All content, trademarks, trade dress, logos, course materials, text, visuals, audio, video, and other intellectual property in the Services are owned by Maison Élevée or its licensors and are protected by applicable laws.

Subject to your compliance, Maison Élevée grants you a revocable, non-transferable, non-sublicensable, limited license to access and use the Services for your personal, non-commercial use only. All rights not expressly granted are reserved.

9. Testimonials; Results; No Guarantee

Any testimonials, examples, or outcomes are not guarantees of results. Individual outcomes vary. We may require that any testimonials be pre-approved by Maison Élevée administration and may include disclaimers.

10. Disclaimers (Maximum Protective)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content will be accurate, complete, or suitable for your purposes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAISON ÉLEVÉE AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PERSONAL INJURY, OR OTHER LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO MAISON ÉLEVÉE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Maison Élevée and its affiliates, owners, officers, directors, employees, contractors, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising from or related to:

13. Termination; Suspension; Refusal of Service

We may suspend or terminate your access at any time, with or without notice, for any reason or no reason, including for suspected violation, risk, fraud, abuse, or conduct inconsistent with the Maison Élevée brand, values, or security.

Upon termination, your license ends immediately. Sections intended to survive (including IP, confidentiality, disclaimers, limitation of liability, indemnity, arbitration) survive.

14. Dispute Resolution: Mandatory Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

14.1 Informal Resolution First

Before filing a claim, you agree to send written notice to maisoneleveeofficial@gmail.com with a description of the issue and your requested resolution. The parties will attempt good-faith resolution for 30 days.

14.2 Binding Arbitration

If unresolved, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered in Nevada, under the rules of AAA, except as provided below.

14.3 Small Claims Carve-Out

Either party may bring an eligible claim in small claims court in Nevada (or your local small claims court if permitted by applicable law), provided it remains an individual claim.

14.4 Injunctive Relief for IP / Confidentiality

Maison Élevée may seek temporary, preliminary, or permanent injunctive relief in a court of competent jurisdiction to protect its intellectual property, confidentiality, or platform security.

14.5 Class Action Waiver

You and Maison Élevée agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

14.6 Arbitration Fees

Arbitration fees will be allocated according to the arbitration rules and applicable law.

15. Governing Law; Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflicts principles. To the extent any claim is permitted in court, exclusive venue shall be state or federal courts located in Nevada, and you consent to personal jurisdiction there.

16. International Use

You are responsible for compliance with local laws where you access the Services. We make no representation that the Services are appropriate or available in all jurisdictions.

17. Changes to Terms

We may update these Terms at any time. Changes are effective upon posting. Your continued use constitutes acceptance. If you do not agree, stop using the Services.
